O WORKSHOP - THE AMERICAN CONSTITUTION.
"The United States (US) Constitution of 1787, a liberal constitution, establishing mostly negative rights (personal liberties), is one of the most enduring constitutions in modern history, besides being much shorter in size than social-democratic constitutions, such as the Mexican Constitution of 1919 e and the Brazilian Constitution of 1988, which bring positive rights, such as health and education.
Judicial interpretation of such Constitution and the meaning of its words, has changed broadly during the history of the US Supreme Court, the highest court in the land, established in Article III of the US Constitution.
Originalism, textualism, pragmatism, structuralism, judicial activism, judicial restraint, natural law, are some of the theories used to interpret the Constitution and its text, some say a enduring constitution others, a living constitution. In this workshop we shall analyze some key Supreme Court decisions (known, as precedents), establishing the true meaning and scope of the US Constitution."
